Planning Board and Zoning Board: A January 2021 Review

A breakdown of Town of Webster projects discussed in January

Webster, NY - We’re at the end of February. FEBRUARY. Seems like just yesterday I was coming up with New Year’s Resolutions that I planned on inevitably forgetting. (Already remembered that I had resolved to watch less Hulu and Netflix… Guess what I was doing just moments before this.)


Anyhoo…


One of the things that I DO really want to keep up with this year involves keeping up with town and village Planning Board and Zoning Board of Appeals projects.


Since I haven’t yet gotten around to reviewing projects discussed in February (I just started the semester teaching an online course for SUNY Brockport, so my responsibilities are very juggled at the moment), here’s a general “breakdown” of the progress of notable projects discussed at Planning Board and Zoning Board of Appeals meetings in January.


Town of Webster Planning Board Meeting:

Jan. 5, 2021


General Business

  • Dave Malta was appointed Vice Chairman of the Town Planning Board.

  • Dave Arena was appointed Secretary of the Town Planning Board.


Project #1: Request for Final Site Plan Approval for a Foot Deck


Applicant Walter Wirlo requested Final Site Plan Approval for constructing a 3,500 square foot deck with a pergola and storage shed (associated with the Ukrainian Cultural Center) located on a 2.25-acre parcel.


When last presented to the Planning Board, the board requested revised plans that included lighting, an additional partition, and a ramp.


The Planning Board granted Final Site Plan Approval with the following conditions:

  • Subject to PRC comments.

  • Subject to Preliminary Approval Conditions.

  • Subject to all applicable governmental fees.

  • Subject to Department of Public Works approval.

  • Significant construction shall occur within one year, as deemed by the Planning Board, to expire on Jan. 5, 2022.

  • The conditions of Preliminary and Final approval are depicted on the cover page of the final designed plans.

  • The engineer for the proposed project shall provide a Letter of Certification that all proposed work was completed, as per Planning Board resolution of final approval, before a Certificate of Occupancy will be issued.

  • Subject to resolution of the final approved minutes.


Project #2: Request for Preliminary/Final Site Plan Approval for Storage Structure


Applicant Paul Kondolf requested Preliminary/Final Site Plan Approval (Public Hearing) to construct a 1,200 square foot accessory structure on a 3.0-acre parcel. The structure would essentially be used for storage.


The structure would be built to match the house. It would include an identical garage door and identical siding. They would also blend the roofing, so that everything maintains the same look.


The Planning Board granted Preliminary and Final Site Plan Approval with the following conditions:

  • That it conforms to the code 225-36 relating to Accessory Buildings.

  • To be used for personal use only; not for rental; and not for any residence.

  • Applicant needs to bring in an updated tape location map to show setback distance.

  • Significant construction shall occur within one year, as deemed by the Planning Board, to expire on Jan. 5, 2022.

Jan. 19, 2021


Project: Request for Sketch Plan Review for Vet Office


Applicant Andrea Blitz (owner of Village Vet) requested Sketch Plan Review for the proposed construction of a 6,000 square foot veterinary office on a 1.44-acre parcel at 40 Commons Boulevard / 896 Ridge Road.


The applicant also wants to include 58 parking spaces, and would acquire the necessary permit for a sign.


The Planning Board offered a recommendation letter to the Zoning Board of Appeals in favor of a 38-foot setback for future development on the site. (The ZBA approved area variance at its Jan. 26 meeting.


The Planning Board granted Preliminary and Final Site Plan Approval for the project at its Feb. 16 meeting.


Town Zoning Board of Appeals Meeting:

Jan. 26, 2021


Project: Request for Area Variance


Applicants Mary and Fred Washburn requested area variances for:

  • 5.5’ (north) side setback where 10’ is required

  • 5.5’ (south) side setback where 10’ is required

  • 16’ front setback where 35’ is required


The variance is linked to the construction of a single-family residence on a .24-acre parcel.


The ZBA approved the area variance with the following conditions:

  • Include a fireplace, not to be cantilevered out.


(Other, minor items were also discussed for smaller projects.)
